I. General Provisions
These Terms of Service (hereinafter referred to as "these Terms") constitute the basic terms of the international logistics service agreement between you (hereinafter referred to as "Client") and Xinjiang Xier International Logistics Co., Ltd. (hereinafter referred to as "we").
By submitting an inquiry, entrustment letter or signing a transport contract through this website, you are deemed to have fully read, understood and agreed to accept all contents of these Terms.
If you are an authorized representative of an enterprise, you confirm that you have obtained full authorization from the enterprise to sign this agreement.
II. Service Content
The international logistics services we provide include but are not limited to:
- Road International Freight: Full truckload/LTL transport from China to Central Asia, Afghanistan, Russia and other destinations
- Rail International Freight: CR Express, China-Central Asia block train booking agent and supporting services
- Customs Declaration & Inspection: Import/export cargo customs declaration, document preparation, policy consultation
- Warehousing Service: Bonded warehousing, sorting, labeling, packaging
- Multimodal Transport: Road-rail-sea flexible combined transport solution design and execution
- Cargo Insurance: Full-process insurance agency and claims assistance
- Cross-border E-commerce B2B Customs: General merchandise/equipment/dangerous goods customs declaration to delivery full process
- Digital Tracking: Real-time cargo status query, online document download
III. Client Obligations
3.1 Truthful and Accurate Information
You should ensure that all cargo information provided (product name, quantity, weight, volume, value, HS code, etc.) is true, accurate and complete. All losses caused by untrue information (including fines, port detention fees, return shipping fees, etc.) shall be borne by you.
3.2 Prohibited Items
The following items are strictly prohibited from being entrusted for transport:
- Explosive and flammable items, hazardous chemicals (without legal procedures)
- Weapons, ammunition, military equipment
- Narcotics, psychotropic drugs, precursor chemicals
- Counterfeit and shoddy goods, items infringing intellectual property rights
- Live animals (unless otherwise agreed in writing and legal procedures handled)
- Other items prohibited from entering or leaving the country by laws and regulations
If we discover that you have entrusted prohibited items for transport, we have the right to immediately terminate services, detain the cargo and report to relevant competent authorities, and shall not bear any compensation liability.
3.3 Packaging Requirements
You should ensure that cargo packaging meets international transport standards and is suitable for long-distance transport and loading/unloading operations. We shall not bear compensation liability for cargo damage, leakage, pollution caused by improper packaging.
3.4 Cooperation with Customs Clearance
If the destination country customs requires supplementary materials or cargo inspection, you have the obligation to promptly cooperate in providing required documents. Port detention fees, warehousing fees, return shipping fees, etc. caused by your untimely cooperation shall be borne by you.
IV. Quotation and Contract Formation
- Quotations provided on this website are reference quots. Final price shall be subject to the "Transport Entrustment Letter" or "Logistics Service Contract" signed by both parties.
- Quotation validity is 7 working days, re-inquiry required after expiration
- Contract is formed and becomes effective from the date of signature and seal by both parties
- If you need to cancel or modify the entrustment, written notice must be given 24 hours before cargo dispatch, otherwise cancellation fees may be incurred
V. Fees and Payment
- Freight settlement method: Prepaid / Collect (as agreed by both parties)
- Invoice: VAT special invoice or ordinary invoice can be issued (complete invoicing information required)
- Overdue payment: For each day of overdue, late fee will be charged at 0.05% of the unpaid amount
- Force majeure fees: Additional fees caused by force majeure (such as port change fees, port detention fees, etc.) shall be borne by the client
VI. Transport Timeliness
We commit to complete transport within the agreed time, but we shall not bear liability for delays caused by the following circumstances:
- Customs inspection, detention or delayed release
- Severe weather, natural disasters, war, strikes, riots and other force majeure events
- Information provided by client is inaccurate or incomplete
- Sudden changes in destination country policies, temporary port closure
- Transport restrictions due to cargo's own nature
Estimated transit time (for reference only):
- Road transport (to major Central Asian cities): 3-7 working days
- Rail transport (CR Express): 10-15 working days
- Multimodal transport: To be determined according to specific plan
VII. Cargo Receipt
- The consignee should complete cargo receipt within 3 working days after cargo arrival
- If outer packaging damage or quantity shortage is found, abnormal conditions should be noted on the receipt form and written notice should be given to us within 24 hours
- Failure to raise written objection within the time limit shall be deemed as cargo delivered intact
VIII. Insurance and Claims
8.1 Insurance
We can handle cargo transport insurance for you. Insurance rate is usually 0.3%-0.5% of cargo value (subject to insurance company's quotation). If you do not explicitly request insurance, we shall handle according to Section 8.2 for any loss during transport.
8.2 Liability Limitation for Compensation
If not insured:
- Road transport: Maximum compensation is 3 times the freight of that shipment
- Rail transport: Execute according to International Railway Goods Transport Agreement and relevant legal provisions
- Compensation does not include: Indirect losses, expected profit loss, market value fluctuation loss
If insured: Claims shall be subject to the loss amount verified by the insurance company, and we assist you in handling claims procedures.
8.3 Claim Timeliness
Claims for cargo damage or loss must be raised in writing within 7 working days after cargo arrives at destination, with relevant proof materials attached (photos, loss list, value proof, etc.). Failure to do so within the time limit shall be deemed as automatically waiving the right to claim.
IX. Force Majeure
If contract performance becomes impossible due to force majeure (including but not limited to natural disasters, war, strikes, riots, government bans, sudden changes in customs policies, infectious disease epidemics, etc.), neither party shall bear breach of contract liability. However, the affected party should promptly notify the other party, and continue to perform the contract or negotiate termination after force majeure disappears.
X. Intellectual Property
All content of this website (including but not limited to text, images, LOGO, layout design, etc.) shall be owned by us. Without written permission, no unit or individual may reproduce, reprint, disseminate or use for commercial purposes.
XI. Privacy Protection
We collect and use your personal information in strict compliance with the Personal Information Protection Law of the People's Republic of China and this website's Privacy Policy. Please refer to the Privacy Policy for details.
XII. Dispute Resolution
- Any dispute arising from or in connection with these Terms shall be settled through friendly consultation between both parties
- If consultation fails, either party may file a lawsuit with the People's Court of our location (Urumqi City, Xinjiang Uygur Autonomous Region)
- During lawsuit proceedings, other terms of these Terms except the disputed part shall continue to be valid
XIII. Miscellaneous
- The right to modify these Terms belongs to us. Revised terms will be published on this website and become effective from the date of publication
- If any term of these Terms is determined to be invalid or unenforceable, it shall not affect the validity of other terms
- For matters not covered in these Terms, execute with reference to relevant laws and regulations such as Civil Code of the People's Republic of China, Maritime Law of the People's Republic of China, etc.
